GENERAL TOUR REGULATION

CHAPTER I

(General Provisions)

 

ARTICLE 1

The following Regulation applies to all participants (drivers or not) who use the services of sightseeing tours organized and promoted by FIGUEIRAADVENTURES, LDA., legal person with NIPC – Legal Person Identification Number – 518014835, with its registered office at Rua Dr. Calado, 15, 1º, Esquerdo, 3080-212 Figueira da Foz, holder of RNAAT – National Register of Tourist Entertainment Agents –339/2024, issued by Turismo de Portugal, will be referred to as “Organizer” for the purpose of this document.

ARTICLE 2

(Definitions)

For the purposes of this Regulation, the following terms and definitions shall apply:

a)     Vehicle: any vehicle owned by the Organizer, or in its possession in any capacity, used by participant, guides or any other person in charge from the Organizer;

b)    Participant: any individual who takes part in the tours promoted by the Organizer, whether paying or not, either as a driver or as an accompanying person;

c)     Driver: an individual participating in the tour, over 18 years of age, holder of a category B driving license, entitled to drive in Portuguese territory, who acts as the driver of a vehicle made available by the Organizer for this purpose, during the tour;

d)    Accompanying person: an individual taking part in the tour, regardless of age, who travels in a vehicle belonging to the Organizer, without driving it.

  

ARTICLE 3

(Activity Description)

This tour is part of a tourist activity, known for being a low-speed tour in T1b category vehicles, known as Buggies. The participant drives the vehicle for a certain period of time, at a pre-established price, under the rules and conditions of the Organizer being always accompanied by a guide throughout the entire tour.

 

ARTICLE 4

(Characteristics of the Route)

All routes are off-road, mostly on dirt tracks, forest areas and national roads, being the entire route pre-defined by the Organizer according to the route chosen by the participant.

The length of the tour is calculated based on an average speed, and the time schedules published are estimated according to the conditions of the route, such as the pace of the tour, weather conditions, traffic, among others beyond the control of the Organizer.

 

ARTICLE 5

(Payment)

Payment must be made exclusively in euros (€), using the following methods:

a)     Bank Transfer

b)    MB Way

c)     Cash

In all three payment methods, the details required for payment will be communicated at the time of purchase and sent by email or by the same means by which the booking was made.

 

ARTICLE 6

(Refunds and Cancellations / Alterations / Annulment)

In the event of needing to cancel an activity for reasons beyond our control, we will notify you as soon as possible and make every effort to offer you an alternative date at your convenience, or we may refund in full the amount already paid.

The Organizer reserves the right to cancel activities in the following cases:

a)     The minimum number of participants required for each activity is not attained;

b)    Weather conditions, natural causes or others that make the activity unfeasible;

c)     Safety conditions are not met;

d)    The conditions foreseen in this regulation are not met.

 

If an activity is canceled due to weather conditions or natural causes, a new booking will be offered, but always subject to the weather conditions on the day.

If you cancel your booking, you can receive a full refund of your payment under the following conditions:

a)     You will receive a full refund if you cancel up to 72 hours before the beginning of the activity, unless the Organizer following the booking made, has already made commitments to other operators involved in the activity.

 

ARTICLE 7

(Conditions for Participation)

Only individuals who meet the following conditions can take part in the Organizer tours:

a)     Have a valid category B driving license, issued by the Portuguese State, or equivalent;

b)    Be between 5 and 75 years old (the driver is allowed from the age of 18 with a category B driving license);

c)     Not be in state of risk or advanced pregnancy;

d)    Not have serious spinal problems or any other equivalent injury;

e)     Not be under the influence of alcoholic beverages, illicit substances or medication that causes drowsiness;

f)     Respect the rules set out in the Portuguese Road Code.

 

ARTICLE 8

(General Rules of Conduct)

Anyone acting as a driver while taking part in any tour promoted by the Organizer is prohibited from:

a)     Driving dangerously, recklessly or disregarding the speed limits imposed by the guide or resulting from the rules of experience;

b)    Distancing from the vehicle in front by more than 10 meters;

c)     Failing to comply with any driving rule in the Portuguese Road Code;

d)    Changing places with a companion or another participant without permission from the guide;

e)     Disrespecting any instructions from the guide or any other person in charge from the Organizer;

f)     Abandoning the vehicle under any circumstances;

g)    Using any electronic device while driving;

h)    Drinking alcoholic beverages or smoking inside the vehicle at any time during the tour;

i)      Take other directions, or change the itinerary, other than those designated by the guide;

j)      Disrespecting the starting and finishing position;

k)    Exchanging vehicles with another driver.

 

CHAPTER II

(Rights and Duties)

 

ARTICLE 9

(Driver's Rights)

The following are the driver's rights: 

a)     To drive the vehicle assigned, while respecting the rules set out in this regulation;

b)    Use the vehicle's horn as a way of alerting the guide to any problems that may occur during the tour or as a way of foreseeing any danger;

c)     In the event of a vehicle breakdown, provided the driver has not acted negligently and there are other vehicles available, continue the tour in another vehicle belonging to the Organizer, or reschedule the tour for another available date.

 

ARTICLE 10

(Driver's Duties)

In addition to the general rules of conduct, the following are the driver's duties:

a)     Payment of 100% of the tour price, as agreed with the Organizer prior to its start;

b)    Presenting valid driving license and ID card to the guide when hiring the services;

c)     Signing a term of responsibility;

d)    *Submission of €200.00 as a security deposit, for damages arising from your conduct;

e)     Correct placement and use of seat belts throughout the ride;

f)      Correct use of the protective helmet (provided by the Organizer);

g)    Respect all guide’s instructions before, during and after the tour;

h)    Take responsibility for the disappearance or damage of personal belongings (cell phones, watches, glasses, accessories, backpacks, clothing, etc.), without being able to claim any compensation from the Organizer, in any way whatsoever, for loss or damage of any personal object;

i)      Ensure that the driver or any accompanying person does not consume alcoholic beverages, illicit substances or medication that disables or affects the responsible and legal driving of the vehicle;

j)      Stop and turn off the engine in case of mechanical doubts or suspicion of an anomaly that could put safety and the vehicle at risk;

k)    Do not throw objects during the tour that could pollute nature or cause damage to third parties or vehicles.

 

ARTICLE 11

(Accompanying person’s Rights)

The accompanying person has the right to be on board during the entire tour. The person may act as the vehicle’s driver during the tour if the needed conditions are met, and the responsibility term referred to in Article 10 c) of this regulation is signed.

 

ARTICLE 12

(Accompanying person’s Duties)

All the obligations inherent to acting as a driver, which result from this regulation, apply to the accompanying person, with the necessary adaptations.

 

ARTICLE 13

(Rights of the Organizer Guide)

The guides appointed by the Organizer for each tour will be of recognized experience and prudence in promoting analogous activities, and are entitled to the following rights:

a)     Changing the route as a way of sanctioning disregard for the clauses described in the regulation;

b)    Not refund participants who give up on the tour willingly and voluntarily.

 

ARTICLE 14

(Duties of the Organizer Guide)

The duties of the guide appointed by the Organizer comprise:

a)     Providing a briefing prior to the beginning of the tour explaining the type of route, safety rules, operation and handling of the vehicle and other required equipment for the tour;

b)    Accompany all drivers during the entire tour;

c)     *Refund the amount of the security deposit corresponding to the total amount given, in accordance with Article 10 d) of the regulation, minus the amount necessary to cover the damage caused by any participant.

 

ARTICLE 15

(Specific Responsibility of the Driver)

§ FIRST: The driver is specifically responsible for any damage to the vehicle caused by improper driving or irresponsible use of the Organizer's vehicles, in accordance with this regulation.

§ SECOND: It is the driver's specific responsibility to stop and turn off the engine if there is any doubt regarding the proper functioning of the vehicle.

 

ARTICLE 16

(Driver and Accompanying person's Consent)

§ FIRST: Consent for the Organizer to use images and videos of you to promote the tours and the company.

§ SECOND: Consent for the Organizer to process and store your personal data after the end of the tour.

 

* Applies only to people aged 23 or under.
